Return Policy & Terms of Sale

Terms of Sale & Return Policy

Welcome to HydraulicHosesNearMe LLC. Because many of our products are custom-fabricated, cut to length, crimped to specification, sourced as special orders, or assembled using components supplied by the customer, we enforce the terms below. By placing an order, submitting a component for service, or accepting delivery, you acknowledge and agree to these terms.

This policy is our conspicuously posted refund and exchange policy for purposes of Connecticut General Statutes § 42-110aa. It states our refund method, applicable time periods, the goods it covers, and the conditions that apply, as required by that statute. Nothing in this policy limits, waives, or overrides any right or remedy available to you under Connecticut or federal law, including the Connecticut Unfair Trade Practices Act (CUTPA, Conn. Gen. Stat. § 42-110a et seq.), the Magnuson-Moss Warranty Act (15 U.S.C. § 2301 et seq., for consumer transactions), or the implied warranties of merchantability and fitness for a particular purpose under Connecticut’s adoption of UCC Article 2. Where any provision below conflicts with such law, the law controls.

1. Final Sale Items

Once manufacturing, assembly, cutting, crimping, or special ordering has commenced, all sales are final on the following items for change-of-mind or buyer’s-error reasons, except as required by applicable law or under the workmanship warranty in Section 9:

  • Custom hose assemblies (hose and fittings supplied by us)
  • Bulk hose cut to a specified length
  • Crimped hose assemblies, fabricated using our stock or special-order components
  • Special-order or non-stock items ordered specifically for a customer
  • Any item built, machined, or modified to customer-supplied specifications

These items cannot be canceled, returned, exchanged, or refunded for change of mind or buyer’s error once work has begun. Consistent with Conn. Gen. Stat. § 42-110aa(b), custom-ordered and customized goods received as ordered, and goods marked “final sale,” are not subject to the statutory return right that otherwise applies when no policy is posted.

2. Customer-Supplied Hose, Fittings & Components

We routinely crimp, fit, or assemble components that a customer brings in or supplies (hose, fittings, adapters, or other parts not purchased from us). Because we do not manufacture, inspect for material defects, or warrant the condition of customer-supplied parts, the following applies:

  • Assumption of part condition: The customer represents that any customer-supplied hose, fitting, or component is genuine, undamaged, correctly rated for the application, and compatible with the other components in the assembly.
  • Workmanship only: Our responsibility is limited to the quality of the crimp or assembly work we perform. We do not warrant the underlying customer-supplied part itself, including pre-existing defects, wear, corrosion, or damage not caused by our work.
  • Verified workshop error: If a crimp or fitting we performed fails due to our workmanship (for example, insufficient crimp depth, an out-of-spec crimp diameter, or an incorrectly selected die/collar for the part), we will re-crimp or reassemble the item at no charge, per Section 9.
  • Component failure: If the failure is due to the customer-supplied part itself (material defect, wrong part for the application, prior damage, incorrect size, or incompatible pressure rating), the repair, replacement part, and associated labor are chargeable to the customer, and we are not liable for resulting downtime, damage, or injury, except to the extent caused by our own negligence.
  • Right to decline: We may decline to crimp or assemble a customer-supplied part we determine to be damaged, counterfeit, mismatched, or unsafe, and will explain why.

Where cause cannot be visually determined, we may recommend the assembly be cut open or sent for failure analysis before liability is assigned; associated costs and turnaround will be discussed with the customer in advance.

Indemnification: To the extent permitted by law, the customer agrees to indemnify, defend, and hold harmless HydraulicHosesNearMe LLC from any third-party claims, damages, or expenses arising from a customer-supplied component, except to the extent caused by our own negligence or willful misconduct.

3. No Exchanges & No Store Credit Policy

No Exchanges: We do not offer direct product-for-product exchanges for change-of-mind or buyer’s-error returns. If you ordered an incorrect stock item, complete a standard return for the eligible item and place a separate new order. Warranty replacements under Section 9 are not “exchanges” for purposes of this Section.

No Store Credit: HydraulicHosesNearMe LLC does not issue store credits or gift cards for returns. All approved returns of stock items are refunded solely to the original payment method, less any applicable restocking fee, as permitted under Conn. Gen. Stat. § 42-110aa. Core charge refunds (Section 5) and deposit returns (Section 8) are refunds of the customer’s own money and are not store credits or product returns.

4. Return Requirements & Restocking Fees

Only standard, unused, uninstalled stock items are eligible for return consideration within 30 calendar days of purchase, pickup, or delivery (whichever is later). Custom-order, cut-to-length, crimped, or non-stock versions of these items are final sale under Section 1.

  • Proof of purchase: An original receipt, invoice, or online order confirmation number is required for all return requests.
  • Condition: Items must be returned in original, resalable condition, in original packaging where applicable, and free of installation marks, cut ends, or fluid residue.
  • Restocking fee: A restocking fee of up to 15% of the item price applies to approved returns to cover inspection and re-shelving. As required by Conn. Gen. Stat. § 42-110aa(a)(2), the existence and amount of this fee are disclosed here as part of our conspicuously posted refund and exchange policy.
  • Return shipping: The customer is responsible for all return shipping, freight, and insurance. Original shipping and handling charges are non-refundable.

Except as required by applicable law.

5. Core Charges & Component Exchange Program

Certain remanufactured or rebuilt components — including cylinders, pumps, motors, and valves — are sold on a core-exchange basis.

  • Core charge: A refundable core charge is added at time of sale, itemized separately from the item price on your invoice.
  • Core return window: The old core must be returned in rebuildable condition (not cracked, welded, burned, or missing major components) within 30 days of purchase to receive the core refund.
  • Non-rebuildable cores: Cores that are damaged beyond rebuild, incomplete, or of the wrong make/model forfeit the core charge, in whole or in part, as determined by us in good faith.
  • Core charge is a deposit, not a purchase price: It is refundable only against return of the old unit and is separate from any standard product return under Section 4.

6. Customer Specifications & Technical Data

Customers are solely responsible for providing accurate measurements, thread types, fitting information, dimensions, working pressure and burst pressure ratings, temperature range, fluid compatibility, and other technical specifications for any custom, cut-to-length, or crimped item.

  • We are not liable for errors, installation issues, incompatibility, or equipment failure resulting from inaccurate, incomplete, or outdated specifications supplied by the customer.
  • Where we recommend a part or configuration based on information provided by the customer, that recommendation is only as reliable as the information given.
  • For critical, high-pressure, or safety-related applications, we encourage customers to confirm specifications against OEM documentation or a qualified engineer before ordering.

7. Rush & Expedited Orders

  • Rush or after-hours fabrication, crimping, or delivery is subject to an expedite fee, quoted at time of request.
  • Expedite fees are non-refundable once work has begun, even if the underlying item would otherwise be eligible for cancellation under Section 8.
  • Quoted rush turnaround times are estimates and are not guaranteed where delays are caused by supplier availability, part sourcing, or conditions outside our control.

8. Deposits & Cancellations

A deposit equal to 50% of the item cost is required for all custom, special-order, and non-stock items prior to ordering materials or beginning assembly.

  • Non-refundable trigger: Deposits become 100% non-refundable once materials have been ordered or fabrication has begun.
  • Before work begins: Orders canceled before material procurement or assembly has started may be canceled without penalty, and the deposit returned in full.
  • Price changes: If raw material or component costs materially increase between deposit and order placement due to supplier pricing changes, we will notify the customer of any price adjustment before proceeding.

9. Defective, Damaged, or Incorrect Items — Workmanship Warranty

Please report a suspected incorrect, shorted, damaged, or defective item within 10 business days of receipt or pickup.

  • Scope of warranty: We warrant the workmanship on assemblies we fabricate or crimp — meaning the crimp, fitting installation, and assembly process — for 90 days from purchase or pickup, unless a different period is stated on your invoice. This is a limited warranty as that term is used under the federal Magnuson-Moss Warranty Act.
  • What’s covered: Verified defects or workshop errors (e.g., improper crimp depth/diameter, wrong die used, mismatched fitting) will be corrected, repaired, or replaced at no additional cost.
  • What’s not covered: Damage from misuse, improper installation by others, exceeding rated pressure or temperature, abrasion, external impact, chemical incompatibility, normal wear, or failure of a customer-supplied component (see Section 2) is not covered.
  • Implied warranties: This limited warranty is in addition to, and does not eliminate, the implied warranties of merchantability and fitness for a particular purpose available under Connecticut’s adoption of UCC Article 2. For consumer transactions, the duration of any implied warranty is limited to the 90-day duration of this written limited warranty, as permitted by 15 U.S.C. § 2308(b), and this limitation is set forth in clear and unmistakable language here and on the face of the warranty.
  • Manufacturer warranties: Stock components we sell but do not fabricate (pumps, valves, cylinders, fittings) are covered by the original manufacturer’s warranty where applicable; we will assist in facilitating a manufacturer warranty claim.
  • Field failures: For assemblies that fail in service, please retain the failed part and any photos of the failure and installation where possible — this materially speeds up root-cause determination and claim resolution.

10. Freight Damage & Shipping Claims

  • Inspect on arrival: Inspect all shipments for visible damage before signing for delivery. Note any damage on the delivery receipt.
  • Concealed damage: Report concealed shipping damage within 5 calendar days of receipt; retain all packaging for carrier inspection.
  • Carrier claims: For items shipped via common carrier or freight line, we will assist with the carrier damage claim, but the claim itself is filed against the carrier, not treated as a standard return.
  • Failure to note visible damage at delivery may limit our ability to recover the claim and, in turn, our ability to replace the item at no cost.

11. Commercial, Fleet & Net-Terms Accounts

  • Net terms: Approved commercial accounts may purchase on net terms as stated on the account agreement or invoice; standard terms are net 30 unless otherwise agreed in writing.
  • Late payment: Invoices unpaid past terms may accrue a late fee not to exceed the maximum permitted under Connecticut law, and may result in suspension of further orders or return of equipment/tools on loan until the account is brought current.
  • Blanket/standing orders: Recurring or blanket orders for fleet maintenance are governed by the applicable master service agreement where one exists; this policy applies to the extent not superseded by that agreement.
  • On-site/mobile service: Service call, mileage, and minimum labor charges for mobile or on-site hose service apply regardless of whether a repair is ultimately completed, unless the visit is canceled with reasonable notice.

12. Rental & Loaner Equipment

  • Rented or loaned tools, crimpers, and equipment remain our property at all times and must be returned in the condition provided, ordinary wear excepted.
  • The renting customer is responsible for repair or replacement cost of lost, stolen, or damaged rental equipment beyond normal wear.
  • Late return of rental equipment is billed at the applicable daily/weekly rate stated in the rental agreement until returned.

13. Hazardous Materials & Fluid Disposal

  • Customers are responsible for properly draining and disclosing residual hydraulic fluid, fuel, or other hazardous contents before returning a component or core for service, return, or core exchange, consistent with applicable Connecticut Department of Energy and Environmental Protection (DEEP) and federal EPA requirements.
  • We may refuse to accept an item containing undisclosed hazardous residue, or may charge a hazmat handling/disposal fee where applicable, quoted at time of service.
  • Disposal of customer-supplied fluids, filters, or contaminated parts is not included in service pricing unless expressly quoted.

14. Industry Standards & Code Compliance

  • Unless otherwise stated on your order confirmation, assemblies are fabricated to SAE J517 (hydraulic hose) and SAE J1942 (marine) standards where applicable to the stated application, and to the working pressure and specification requested at time of order.
  • It is the customer’s responsibility to identify if an application is subject to a specific regulatory or code requirement (e.g., DOT vehicle service, mining, food-grade, marine) at the time of order; standards will not be assumed or applied retroactively.
  • We are not responsible for non-compliance resulting from an application, industry, or use-case not disclosed to us at the time of order.

15. Order Pickup & Abandonment

Pickup Window: Orders must be picked up within 10 business days of being notified that the order is ready.

Abandonment: Orders remaining uncollected after 30 days will be considered abandoned. Before disposal, we will send written notice to the customer’s last known mailing address or email address on file at least 15 days before any disposal, and may assess reasonable storage fees for the intervening period. Disposal of abandoned property will be handled in a manner consistent with Connecticut law governing a repairer’s or bailee’s rights in unclaimed property (including any applicable lien, notice, or sale procedure that applies to our business), or as otherwise permitted by law. We do not assert a right to dispose of abandoned goods by self-help beyond what Connecticut law permits. All past deposits or payments on abandoned items may be applied to storage and disposal costs, with any surplus handled as required by law.

16. Limitation of Liability

Because hydraulic systems operate under extreme pressures and conditions, the buyer assumes all risk associated with the installation and use of these products.

  • Total liability cap: To the maximum extent permitted by law, our total liability arising from any order, product, or service is limited to the amount you paid for the specific goods or service giving rise to the claim.
  • Consequential damages: HydraulicHosesNearMe LLC shall not be liable for any indirect, incidental, special, or consequential damages — including, but not limited to, equipment downtime, loss of profits, property damage, or labor costs — resulting from the use, misuse, or failure of any product purchased from or serviced by us, except to the extent such failure is a verified workshop error under Section 9, and except as otherwise required by applicable law.

Nothing in this section limits our liability for personal injury or death caused by our own negligence, or for any other liability that cannot lawfully be limited or excluded. Connecticut and other states may not permit the exclusion or limitation of incidental or consequential damages for injury to the person in the case of consumer goods, so this limitation may not apply to you.

17. Force Majeure

We are not liable for any delay or failure in performance caused by events beyond our reasonable control, including acts of God, severe weather, fire, flood, earthquake, war, terrorism, civil unrest, labor disputes, supplier failures, transportation delays, utility or internet outages, government action, or epidemics or pandemics.

18. Governing Law, Severability & Entire Agreement

  • These terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles, except where superseded by mandatory federal law or consumer protection law.
  • Venue: Any legal action or proceeding arising under these terms shall be brought exclusively in the state or federal courts located in Connecticut, and the parties consent to the personal jurisdiction and venue of such courts, except where applicable consumer protection law requires or permits otherwise.
  • Nothing in these terms constitutes a waiver of any right under the Connecticut Unfair Trade Practices Act (CUTPA, Conn. Gen. Stat. § 42-110a et seq.) or any other non-waivable Connecticut or federal consumer protection statute.
  • If any provision of this policy is found unenforceable, the remaining provisions remain in full effect.
  • These terms, together with your order confirmation and any signed agreement, constitute the entire agreement regarding the subject matter, and supersede any terms or conditions proposed by the customer (including on a customer purchase order), unless we expressly agree to such terms in writing. In the event of a conflict between these terms and an invoice or signed agreement, the signed agreement controls, then these posted terms, then the invoice, except where applicable law requires otherwise.
  • We may update this policy from time to time; the version conspicuously posted at the time of your order governs that transaction.

19. Acceptance by Conduct

For in-person or phone orders where no written order confirmation is issued, these terms apply upon our acceptance of the order or commencement of work, whichever occurs first. By submitting a component for service, you agree to these terms.

20. Risk of Loss, Taxes & Payment

  • Risk of loss: Title and risk of loss pass to you upon delivery to the carrier or upon pickup, whichever applies.
  • Taxes: Prices exclude applicable sales, use, and excise taxes unless expressly stated otherwise. You are responsible for all such taxes.
  • Payment: We accept the payment methods posted at our location or on our website. Returned checks or failed payments may incur a fee to the extent permitted by law.

21. Labor & Shop Supplies Charges

  • Shop supplies fee: Labor charges on crimping, fabrication, and service work include a shop supplies fee, which covers consumables, small hardware, cleaning and lubrication materials, tooling wear, and environmental/compliance costs incurred in performing the work. This fee is disclosed on your invoice or work order, typically as a flat amount or a percentage of labor.
  • Non-refundable: Labor charges and the associated shop supplies fee are earned once work has been performed and are non-refundable, consistent with Section 1, except to the extent a charge relates to a verified workshop error corrected under Section 9.
  • Applies regardless of outcome: Because shop supplies are consumed in the course of performing the work, the shop supplies fee applies whenever labor is billed, even if the underlying part or component is later found to be defective, returned, or replaced.

22. Confidentiality

In the course of providing quotes, custom fabrication, or engineering solutions, either party may disclose non-public information to the other (a “Disclosing Party” and “Receiving Party,” respectively) — including specifications, drawings, pricing, and technical or business information. The Receiving Party agrees to keep such information confidential and to use it solely to fulfill its obligations under these terms, and not to disclose it to any third party without the Disclosing Party’s prior written consent, except as necessary to comply with applicable law or to enforce its rights under these terms.
